Its Mediterranean lifestyle, excellent infrastructure, political stability and strong long-term property market have transformed the island from a holiday hotspot into one of the continent’s most sought-after locations for second homes, permanent residences and investment properties.

Yet, while purchasing real estate in Mallorca is relatively straightforward, it differs significantly from the buying process in many other countries. Understanding the legal framework and surrounding costs before signing any documents is essential for a successful acquisition.

Preparation Comes Before Property Viewings

Many buyers begin by falling in love with a villa overlooking the sea or a charming townhouse in one of Mallorca’s historic villages. However, the first step should be financial and strategic planning.

Establishing a realistic budget means considering not only the purchase price but also acquisition costs such as taxes, legal fees, notary expenses and registration costs. Depending on the type and value of the property, these additional costs generally amount to around 10–13% of the purchase price, although they can be higher for premium properties.

Equally important is understanding the tax implications of the purchase. Every buyer’s circumstances are different, making professional tax advice highly advisable before committing to a transaction.

Navigating Mallorca’s diverse property market can be challenging without local knowledge. Whether searching for a contemporary villa in Son Vida, a frontline apartment in Port d’Andratx or a traditional finca in the countryside, each location has its own market dynamics and pricing.

Understanding the Purchase Process

The buying process in Mallorca generally follows several clearly defined stages.

After agreeing on the principal terms, the parties typically sign a reservation or deposit agreement, commonly referred to as an Arras contract. This document outlines the agreed purchase price, payment schedule and completion timetable. A deposit—often around 10% of the purchase price—is usually paid into an escrow account to secure the transaction.

Following successful legal checks, the transaction concludes with the signing of the public deed of sale (Escritura de Compraventa) before a Spanish notary. At this stage, the remaining balance, together with applicable taxes and fees, is paid, and ownership is subsequently registered with the Land Registry.

Legal Requirements Every Foreign Buyer Should Know

One of the first administrative requirements for non-Spanish buyers is obtaining an NIE (Número de Identificación de Extranjero), the tax identification number required for any property purchase in Spain.

Buyers should also understand the difference between purchasing a resale property and a newly built home. Existing properties are generally subject to Property Transfer Tax (ITP), while new developments are subject to VAT (IVA) together with Stamp Duty (AJD). The applicable rates depend on the property’s characteristics and current regional legislation.

Although Mallorca’s property market remains highly attractive, successful purchases are rarely rushed. Buyers who take the time to understand the market, seek independent legal and financial advice, and work with experienced local professionals are far more likely to enjoy a seamless transaction.
